SPACS College Online Examination Portal

These Terms & Conditions ("Terms") form a legally binding agreement between you ("you", "your", or "User") and the School of Paramedics Studies (SPACS College) ("SPACS", "we", "us", or "our") governing your access to and use of the SPACS College Online Examination Portal and all related websites, applications, proctoring tools, and services (collectively, the "Portal"). Please read them carefully. They apply to students, faculty, external examiners, administrators, and any other authorised user, anywhere in the world. Your use of the Portal is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

2. Acceptance & Eligibility

By creating an Account, ticking the acceptance box during registration, or otherwise accessing or using the Portal, you acknowledge that you have read, understood, and agree to be bound by these Terms and the Privacy Policy. If you do not agree, you must not access or use the Portal.

2.1 Age Requirement

The Portal is intended for individuals who are at least 18 years of age, or at least 16 years of age with the verifiable consent of a parent or legal guardian where permitted by the law of your country of residence. By registering, you represent that you meet this requirement. We do not knowingly permit children below the applicable age to register without the required consent.

If you use the Portal on behalf of an institution or another person, you represent that you are authorised to accept these Terms on their behalf.

The Portal provides a secure, proctored online examination and assessment environment. Access and permissions depend on your assigned role:

7. Remote Proctoring & Monitoring

To protect the integrity of assessments, the Portal uses automated and human-assisted proctoring. By taking a proctored examination, you provide your informed, explicit consent to the collection and processing of Proctoring Data as described here and in the Privacy Policy.

7.2 How it is used

Proctoring Data is used solely for identity verification, examination supervision, integrity investigations, and dispute resolution. It is stored securely, access-restricted, and retained only as long as necessary (see the Privacy Policy). Automated flags do not by themselves determine an outcome — a human reviewer evaluates flagged sessions, and you have the right to request human review of any decision (see Privacy Policy, "Automated Decision-Making").

Your choice: Biometric identity verification and proctoring are conditions of sitting a proctored examination. If you do not consent, you may not be able to take the examination online; contact SPACS to discuss alternative arrangements where available.

Where fees apply to a programme, examination, or service, they will be disclosed to you before you incur them. Unless required by law or stated otherwise, fees are non-refundable once an examination has been accessed or a service rendered. You are responsible for any taxes associated with your use of paid services.

10. Third-Party Services

The Portal relies on trusted third-party providers (for example, cloud hosting, database, email delivery, and proctoring/System technologies). Your use of the Portal may be subject to those providers' terms. We are not responsible for the acts or omissions of third parties, but we take reasonable steps to engage providers that maintain appropriate security and data-protection safeguards.

11. Data Protection & Privacy

We process Personal Data in accordance with the Jamaica DPA and, where applicable, other data protection laws (including the EU/UK General Data Protection Regulation for users in those regions). Our Privacy Policy explains what we collect, why, the legal bases we rely on, how long we keep it, and your rights. By using the Portal you acknowledge that Personal Data may be transferred to and processed in countries other than your own, subject to appropriate safeguards.

We strive to keep the Portal available and reliable, but to the fullest extent permitted by law the Portal and all Content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Portal will be uninterrupted, error-free, secure, or free from harmful components, or that any defect will be corrected. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited.

14. Limitation of Liability

To the fullest extent permitted by applicable law:

These limitations do not apply to liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

15. Indemnification

You agree to indemnify and hold harmless SPACS and its officers, employees, and agents from any claims, damages, losses, liabilities, and reasonable expenses (including legal fees) arising out of your breach of these Terms, your misuse of the Portal, or your violation of any law or third-party right.

16. Suspension & Termination

We may suspend or terminate your access to the Portal, with or without notice, if you breach these Terms, where required by law, or to protect the security, integrity, or proper operation of the Portal. You may stop using the Portal at any time and may request deletion of your Account subject to our record-keeping obligations described in the Privacy Policy. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.

17. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of Jamaica, without regard to its conflict-of-laws principles. Subject to any mandatory consumer-protection rights available to you in your country of residence, you agree that the courts of Jamaica shall have jurisdiction over any dispute arising out of or relating to these Terms or the Portal.

Before commencing formal proceedings, the parties agree to attempt in good faith to resolve any dispute through informal negotiation by contacting info@spacscollege.com.

International users: We make the Portal available to users worldwide. You are responsible for complying with the laws of your own jurisdiction. Nothing in these Terms removes any non-waivable statutory protection you may have under your local law.

18. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date and notify users through the Portal and/or by email. Your continued use of the Portal after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Portal.
